GENERAL LIABILITY WAIVER & ASSUMPTION OF RISK

BERNAU ENTERPRISES LLC DBA PLAYGROUNDS DART ZONE GENERAL LIABILITY WAIVER & ASSUMPTION OF RISK

1. AGREEMENT TO PARTICIPATE
In consideration of being allowed to use the facilities, equipment, and participate in activities provided by Bernau Enterprises LLC (d/b/a Playgrounds Dart Zone) including escape rooms, Nerf battles, and related events, I acknowledge and agree to the following terms:

2. ACKNOWLEDGMENT OF RISKS
I fully understand and acknowledge that participating in escape rooms and/or Nerf Arena activities includes inherent risks, which may result in injury or illness, such as strains, sprains, fractures, cuts, eye injuries, emotional or psychological distress, heat-related illness, heart conditions, or even death. These risks may arise from my own actions, the actions of others, the condition of the facility, equipment failure, or natural causes. I accept and assume full responsibility for these risks, whether foreseeable or unforeseeable.

3. RELEASE & HOLD HARMLESS
On behalf of myself, my heirs, personal representatives, and next of kin, I hereby release, waive, discharge, and agree not to sue Playgrounds Dart Zone and its owners, officers, agents, employees, contractors, affiliates, and property owners, for any loss, damage, injury, or death sustained during my participation. I agree to indemnify and hold harmless Playgrounds Dart Zone from any and all claims, including attorney’s fees, arising from my participation.

4. NEGLIGENCE
I understand that this waiver applies even if Playgrounds Dart Zone is negligent in supervising, organizing, or maintaining the facilities or equipment, except for willful or gross negligence or intentional misconduct.

5. COMPLIANCE & TERMINATION
I agree to comply with all rules, instructions, and safety procedures established by Playgrounds Dart Zone. I understand that failure to comply may result in my removal from the activity without refund. Playgrounds Dart Zone also reserves the right to modify or cancel activities at any time.

6. MEDIA RELEASE
I consent to the use of photographs or video recordings taken during my participation by Playgrounds Dart Zone for promotional purposes without compensation.

7. PERSONAL PROPERTY
I acknowledge Playgrounds Dart Zone is not responsible for lost, stolen, or damaged personal belongings.

8. NO MEDICAL ADVICE OR SERVICE
I acknowledge that Playgrounds Dart Zone does not provide medical advice or treatment. I will seek professional medical advice if needed and affirm that I am physically able to participate.

9. SEVERABILITY & GOVERNING LAW
If any provision is deemed invalid or unenforceable, the remaining provisions shall remain in full force.
This waiver is governed by the laws of the State of Arizona.

10. MINOR PARTICIPANT (UNDER 18)
I certify that I am the parent or legal guardian of the minor named below. I have read and understand this waiver and agree to all terms on behalf of the minor. I understand that I am also waiving claims and assuming risks on behalf of the child.
